Themescape

Terms of use

Last updated 23 October 2026

These terms are the agreement between you and Themescape Limited for using Themescape. By creating an account or using the app, you agree to them. Please read them with the Privacy statement, which explains how we handle your information.

Who we are

Themescape is run by Themescape Limited, a New Zealand company, number 9459933, with its registered office at 168 Hawthornden Road, Avonhead, Christchurch 8042. In these terms, "we" and "us" mean Themescape Limited, and "you" means the person using Themescape. You can reach us at support@themescape.co.nz.

What Themescape does

Themescape turns qualitative data you have already coded into a map of your themes, codes and quotes that you can explore, refine and present. The app runs in your web browser, which reads your files on your own computer. We do not receive or store your research data, so we cannot recover a project for you: please save your progress to your own computer as you work.

We keep improving Themescape, so features may change. We aim to keep the app available at all times, but it may sometimes be unavailable for maintenance or for reasons outside our control.

Your account

You need an account to use Themescape with your own data. Please give accurate details, keep your password to yourself, and tell us straight away at support@themescape.co.nz if you think someone else has used your account. Each account is for one person: please do not share your login.

Themescape is for researchers and university students aged 16 or over.

Plans, trials and payment

Individual plans are paid monthly, by semester or yearly. Team plans cover 2 to 19 people, and organisation plans 20 or more. Prices for individual and team plans include GST; organisation prices are shown plus GST. The price and what is included are shown before you pay. Payments are taken by Stripe, and a plan renews automatically at the end of each billing period until you cancel it.

Individual and team plans start with a 7 day free trial. You are not charged if you cancel before the trial ends; otherwise the first payment is taken when it ends. During the trial some features are closed, as shown in the app.

The Student plan is for people currently studying at a university. We confirm this from your university email address, and may ask again later.

You can cancel a plan at any time from Manage billing on your Account page. It then stays open until the end of the period you have paid for and does not renew. We do not refund the unused part of a period, except where the law requires us to. If a payment fails, we will email you and try again, and the plan ends if payment cannot be taken.

Organisation licences are sold by quote and invoice. The licence, its number of seats and its period are set out in the invoice, and the licence opens when the invoice is paid. The person who asked for the quote becomes the licence administrator. We email the administrator before the licence ends, and a renewal invoice follows unless the organisation tells us it will not renew.

We may change our prices. A change applies from your next billing period, and we will email you at least 30 days before it takes effect, so that you can cancel first if you wish.

Teams and organisations

If you buy seats for a team, or administer an organisation licence, you choose who receives a seat and you are responsible for inviting only people who expect to hear from us. Removing someone ends their access through your team or licence. Their own files stay on their own computers.

Your research data and your responsibilities

Your research data, your coding and anything you make with Themescape, including exported figures, belong to you. Because your data stays on your computer, you are responsible for storing and backing it up, and for using it as your ethics approval, your participants' consent and the law allow.

The optional live Google Sheets mode reads a sheet that anyone with its link can open. Use it only for data that is not confidential, never for participant data or identifiable data.

Themescape helps you see and present your analysis; it does not do the analysis for you. You remain responsible for your interpretation and for checking what you publish.

Fair use

Please do not misuse Themescape. In particular, do not try to get around plan limits or access checks, share activation codes with people they were not meant for, copy, resell or reverse engineer the app, interfere with its security or other people's use of it, or use it for anything unlawful. If you do, we may suspend or close your account. Unless the misuse is serious, we will tell you first and give you a chance to put it right.

Our intellectual property

Themescape, its design, its software and its name and logo belong to Themescape Limited. Your plan gives you a personal right to use the app while it is active; it does not transfer any ownership. If you send us a suggestion or feature request, we may use it freely to improve Themescape.

Our responsibility to you

If you use Themescape for the purposes of a business, including research for a university or other organisation, you agree that the Consumer Guarantees Act 1993 does not apply, and that sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply between us, because both of us are in trade and agree that it is fair to contract out of them. If you use Themescape as a consumer, nothing in these terms limits your rights under those Acts.

Apart from those rights, Themescape is provided as it is, and we do not promise that it will be free of errors or always available. To the extent the law permits, we are not liable for any loss of data, profits or opportunity, or for any indirect loss, and our total liability to you for anything to do with Themescape is limited to the amount you paid us in the 12 months before the claim arose.

Ending these terms

You can stop using Themescape and delete your account at any time from Your data on the Account page, as the Privacy statement describes. We may close an account that breaks these terms, as set out under Fair use. If we ever stop providing Themescape, we will give at least 30 days' notice by email and refund any period you have paid for and not used.

Changes to these terms

We may update these terms as Themescape changes. The date at the top shows the current version. If a change is significant, we will email members at least 30 days before it takes effect. Continuing to use Themescape after that means you accept the change.

The law that applies

New Zealand law governs these terms, and the courts of New Zealand can decide any dispute about them. If any part of these terms cannot be enforced, the rest still applies. If you have a concern, please email support@themescape.co.nz first, and we will try to sort it out with you.
